Labor and Employment

Our extensive labor and employment experience includes assisting employers in remaining union free and as well as in work force restructurings, representing management in collective bargaining, grievance and alleged discrimination matters, handling unfair labor practice charges and strike preparations, preparing position statements to administrative agencies, and representing clients in fact-finding, mediation, litigation and arbitration.

We prepare employment and separation agreements for both employers and executive employees, which agreements routinely include trade secret, confidentiality, non-competition, non-solicitation, and invention assignment clauses. We also assist employers in preparing handbooks as well as developing and implementing personnel policies dealing with a host of matters including the employment-at-will doctrine, the prevention and investigation of sexual and other harassment, AIDS, The Americans With Disabilities Act, references, workplace violence, leaves of absence, smoking in the workplace, and use of computer equipment, the Internet, e-mail, and cell phones.

We counsel many of our clients on a day-to-day basis about hiring techniques, discipline, termination, and workforce restructuring issues. Although we have extensive litigation experience in both the state and federal courts on a wide-range of labor and employment issues, we believe in taking a preventive approach to these problems to try to keep our clients out of court.
